UNDERSTANDING TRADITIONAL RIGHTS IN ARTICLE 18B PARAGRAPH 2 OF THE 1945 CONSTITUTION

This paper explores the original intent of the phrase “traditional rights” in the post-amendment 1945 Constitution, referring to its relation to “original rights” before the amendment. The analysis is drawn from HuMa Indonesia’s (2020) study on the legal framework for customary forests and the recognition of Indigenous Peoples’ rights.
